Terms of Service

These terms govern the services provided by westbay plumbing and heating LTD (“we”, “us”, “our”). By booking with us you agree to these terms. They do not affect your statutory rights as a consumer, which always apply.

1. Our services

We provide the trade or service described at the time of booking. We will carry out our services with reasonable care and skill and within a reasonable time, as required by the Consumer Rights Act 2015.

2. Quotes, estimates and prices

A quote is a fixed price for the work described. An estimate is our best guide to the likely cost and may change if the work actually needed differs. Prices include VAT where we are VAT-registered. The price shown at booking is the price that applies unless we agree a change with you in advance.

3. Extra or changed work

If the job needs work beyond what was booked, we will explain it and, where reasonably possible, agree the extra cost with you before carrying it out. You are only charged for additional chargeable work you have agreed to.

4. Booking, deposits and payment

Bookings are made through our website. Any deposit, the balance, and when each is due are shown to you before you confirm. Payments are processed securely by Stripe and settle to us directly; we do not store your full card details. If an invoice is not paid by its due date we may charge reasonable interest on the overdue amount until it is paid.

5. Access and your responsibilities

So we can work safely and on time, please give us safe and reasonable access, accurate information about the job, and any permissions or consents that are needed (for example from a landlord or freeholder). If we cannot start or finish because access was not available or the information given was wrong, we may charge a reasonable amount for wasted time or a repeat visit.

6. Your right to cancel

Bookings made online or away from our premises normally carry a statutory 14-day right to cancel under the Consumer Contracts Regulations 2013. Where any term here conflicts with your statutory rights, your statutory rights prevail.

7. Guarantees and workmanship

Your rights under the Consumer Rights Act 2015 apply to everything we do — services must be carried out with reasonable care and skill, and any goods we supply must be of satisfactory quality, fit for purpose and as described. Any guarantee or warranty we choose to give is in addition to, and does not replace, these statutory rights. Parts and materials may also carry a manufacturer’s own warranty.

8. Materials and parts

Ownership of any materials or parts we supply passes to you once you have paid for them in full. Until then they remain ours.

9. If something is not right

Please tell us as soon as possible so we can put it right — see our Complaints page. Under the Consumer Rights Act 2015 you may be entitled to have substandard work put right, or to an appropriate price reduction, depending on the circumstances.

10. Our responsibility to you

Nothing in these terms limits or excludes our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud, and for anything else that cannot be limited or excluded under law. Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill; we are not responsible for loss or damage that was not foreseeable, or for business losses. Where our liability is not otherwise fixed by law, it is limited to the price paid for the service concerned. We hold appropriate insurance for our work.

11. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control (for example extreme weather, accidents, or supplier failures). If such an event happens we will contact you as soon as possible and arrange a new time; if you prefer, you can cancel and receive a refund for any work not yet done.

12. Health and safety

We work to the health-and-safety standards required for our trade. If we reasonably believe it is unsafe to start or continue, we may stop work and will explain why.

13. Website content

The content of our website belongs to us or our licensors and may not be copied or reused without our permission.

14. Changes to these terms

We may update these terms from time to time. The version that applies to your booking is the one published when you booked. The date this page was last updated is shown above.

15. If part of these terms cannot be enforced

If any part of these terms is found not to be enforceable, the rest still apply.

16. Governing law

These terms are governed by the law of England and Wales, and disputes may be brought in its courts (or the courts of your home nation within the UK where the law allows).
