1. About this agreement

These Terms of Service govern your use of the booking platform operated by OptiTech Automation, a sole trader, with its principal place of business at Torquay, Devon, UK (“OptiTech Automation”, “we”, “us”, “our”).

By using our platform to browse, request, or confirm a booking, you agree to these terms. If you do not agree, please do not use our services.

2. Service description

OptiTech Automation provides a technology platform that enables trade businesses (“Businesses”) to offer and manage bookings with their customers (“Customers”). We facilitate the booking process; the underlying trade service is provided by the Business, not by OptiTech Automation. We are not a party to the service agreement between the Business and the Customer.

3. User obligations

When using our platform you agree to:

  • Provide accurate, complete, and up-to-date information when making a booking.
  • Not use the platform for any unlawful or fraudulent purpose.
  • Not attempt to circumvent security or access controls on the platform.
  • Treat Business staff with courtesy and respect.
  • Honour bookings you have confirmed or notify the Business promptly if you cannot attend.

4. Booking and cancellation policy

When you confirm a booking, you enter into a direct contract with the Business for the provision of trade services. Cancellation terms are set by the Business; however, the following defaults apply unless the Business has communicated different terms:

  • 24 hours or more notice: You are entitled to cancel and receive a full refund of any deposit paid, less any processing fees charged by our payment provider.
  • Less than 24 hours notice: The Business may retain a partial deposit to cover preparation costs. The specific amount is communicated at the time of booking.
  • No-show: If you do not attend without cancelling, the full deposit may be forfeited.

5. Deposits and forfeiture

A deposit may be required at the time of booking. The deposit amount is displayed clearly before you confirm. The deposit is held to confirm your intent and compensate the Business for time reserved on your behalf.

You will forfeit your deposit if you:

  • Cancel with less than 24 hours notice without a reasonable excuse.
  • Do not attend the appointment without prior cancellation.
  • Provide materially false information when booking.

Where a dispute arises about forfeiture, it will be handled in accordance with section 7 of these terms.

6. Right to cancel (Consumer Contracts Regulations 2013)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a booking within 14 days of confirming it, without giving any reason, unless the service has already commenced with your agreement before the 14-day period expires.

To exercise your right to cancel, you must inform the Business clearly of your decision to cancel (for example, by email or letter). If the service has not yet commenced, you will receive a full refund within 14 days of the Business receiving your cancellation notice.

If you requested the service to begin during the 14-day cancellation period and then cancel, you may be required to pay a proportionate amount for the service provided up to the point of cancellation.

7. Limitation of liability

OptiTech Automation acts as a technology intermediary and is not responsible for the quality, safety, or legality of the trade services provided by Businesses. Our liability to you in connection with the platform is limited to the greater of:

  • The deposit amount paid by you for the relevant booking; or
  • £100.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under English law.

8. Dispute resolution

We encourage you to contact us first at hello@optitechautomation.co.uk if you have a dispute. We aim to resolve all complaints within 5 working days.

These terms are governed by the laws of England and Wales. Any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer and your dispute is with the Business (not OptiTech Automation), you may be entitled to use an alternative dispute resolution (ADR) scheme. Details are available from the Business or from the Citizens Advice Bureau.

9. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via the platform at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the updated terms.
